The signature ink wasn’t quite wet on the declaration Monday night as well over a dozen ridiculous state governments filed a suit in the (guess) Ninth Circuit in (where else?) San Francisco seeking to stop the declaration of national emergency by the president on border barrier funding.
Yes, “barrier.” “Wall” is soooo 2018.
The president expected this and is set to fight the case to its likely eventual place on the docket of the Supreme Court. No matter the majority of the high court, by their past court opinions, looks firmly in favor of the declaration. No matter the president would win any override fight on this in Congress. No matter a solid majority of the American people are in favor of a tough immigration policy. The Dems will still sue and delay because they are captive to a vocal minority of hard leftists who call their shots on this and other matters.
Which, of course, will go a long way to the president’s reelection.
Now I know it’s easy to get frustrated by a single court’s ability to gum up the works. But this is a nation of the rule of law, not of men. If we prize limitations on government, then we have to put up with it now as it can be used as a shield at other times. Under Obama, we may remember the courts were quite useful in limiting his executive overreach. Also remember the recent temporary travel ban from certain countries the president proposed? We lost the 9th on that one and won in front of SCOTUS. Case closed.
Yeah, we’ll have to tolerate the cacophony for a while. But the tea leaves auger well for a favorable outcome for the president and for the country.
