The precedent already has been set: A New York jury has awarded a 22-year-old woman $2 million from the doctors accused of pushing her into a double mastectomy when she was a minor, and was subjected to the “transgender” ideology.

The case brought by Fox Varian, now 22, was the first such medical malpractice in the nation to go to trial, and deliver a victory for her.

Now the Texas Supreme Court has opened the door for a followup decision, ruling unanimously in favor of Independent Women ambassador and detransitioner Soren Aldaco.

Her medical malpractice case against her former therapist and Three Oaks Counseling Group now will proceed. The defendants had wanted the case thrown out.

She said, “It always astonishes me to find myself at the center of a moment this big, because I do this work for the people who come after me—and that means I sometimes lose myself in the weight of it. Today the Texas Supreme Court unanimously ruled that my case deserves to be heard, and that providers implicated in harming vulnerable patients can’t twist the statute of limitations to escape accountability.

“This ruling is a watershed moment. The Court’s opinion is already sending shockwaves far beyond Texas. The direct impact will be felt here at home—but providers across the country, and federally, will now think twice about their responsibility to patients. And patients will see, through the model established here in Texas, that they deserve to be protected and taken seriously.”

The providers argued that the statute of limitations was started by a letter recommending she undergo “transgender” treatment, and the time limit for filing a case had expired. The court said it started later, when the procedures were done.

The court said, “The court of appeals rejected Aldaco’s arguments and held that the clock began ticking on February 22, 2021, when Wood ‘penned and provided the allegedly tortious recommendation letter’ without which the double mastectomy couldn’t have occurred… We disagree.”

Varian, by the New York jury, was awarded $1.6 million for past and future pain and suffering, and another $400,000 for future medical expenses.

Her case was the first malpractice case by a detransitioner against providers.
