A jury has been picked in Wisconsin in a trial that will determine whether a judge is convicted and could face up to six years in prison for allegedly helping an illegal alien criminal escape federal authorities who were on hand to detain him.
The judge hearing the case against Hannah Dugan, a suspended Milwaukee County Circuit Court judge, on charges of felony obstruction and misdemeanor concealing an individual, U.S. District Judge Lynn Adleman, has confirmed that a judge can’t be held criminally liable for judicial acts done in good faith.
But an analysis of the case at Courthousenews confirmed, “Based on the facts in the indictment, her actions don’t fall into the narrow exception.”
Dugan is accused of helping illegal alien criminal Eduardo Flores-Ruiz hide and avoid ICE agents armed with a warrant.
“Flores-Ruiz appeared in Dugan’s courtroom on April 18 for a pretrial conference related to multiple counts of battery and domestic abuse, according to court records. When ICE agents arrived to arrest him, she left the courtroom and ordered the agents to first speak to Chief Judge Carl Ashley,” the report said.
“Upon returning to her courtroom, the government says she held an off-record conference with Flores-Ruiz and his attorney to reschedule his hearing before apparently leading them through a back door into a private hallway.”
Actually video surveillance shows the illegal alien and his lawyer escaping through a “jury door.”
A week later, Dugan was arrested by the FBI, suspended by the Wisconsin Supreme Court, and subsequently was indicted by a grand jury.
The jury was seated shortly after the case opened this week, and it could last weeks.
Courthousenews said, “Assistant U.S. Attorney Richard Frohling indicated he will call at least 25 witnesses over four days. This will include ICE agents involved in the April 18 incident, Flores-Ruiz’s defense attorney, an unnamed attorney sitting at the defense table awaiting his client’s case to be called and other courtroom witnesses.”
Her defense claims Dugan was following orders from Ashley on dealing with arrests of criminals in the courthouse building, and Ashley is scheduled to testify.
However, Dugan’s claims that she has immunity for her actions, as a judge, were shot down, as were her claims it was a targeted prosecution.
Dugan is trying to suppress most of the evidence contained in an audio recording made in the court that day.
If convicted, Dugan faces the possibility of imprisonment for up to six years and substantial fines.
