New Immigration Law Seeks to Prosecute Elected Officials Obstructing Federal Agents

If you have been following me at all, you know that I have railed against the insanity of illegal immigration for years. I have written about the absurdity of the IRS paying out billions to illegals, how the MS-13 gang used DACA loopholes to get into the country, and whether we should end the asylum program altogether.

But we all know that liberals are all for open borders because, by and large, these illegals (and even those who are legal) tend to vote Democrat. In short, they want open borders to increase votes. It’s the only way they can win.

But what do we do when these very same politicians break federal law to carry out their nefarious plans? Why are we not enforcing the laws that are on the books? Well, those questions could now very well be moot based on new legislation that was just proposed by Rep. Steve King (R-IA).

In short, the new proposed legislation would require the paid public servant to be sent directly to jail for violating federal immigration law.

So, who is responsible for being the impetus behind King’s bill? Well, none other than Mayor Libby Schaaf of Oakland, California. The very person the bill is named after: The Mayor Libby Schaaf Act of 2018.

In case you didn’t know, Libby Schaaf is the mayor who warned illegals in Oakland of an impending Immigration and Customs Enforcement (ICE) raid. As reported by Fox News: The mayor said she didn’t know further details of the ICE operation, but claimed she felt it was her “duty and moral obligation as mayor to give those families fair warning when that threat appears imminent.”

So she placed the rights of her legal residents and constituents on the back burner, preferring instead to protect illegals and place law enforcement officials in harm’s way. Imagine if the roundup would have been directed toward major felony offenders or MS-13? What if they decided to set an ambush for ICE officers…just to make a statement? Consider Kate Steinle. Was she protected in the sister sanctuary city of San Francisco when she was gunned down by a criminal illegal alien who had been deported multiple times?

The end result of Schaaf’s actions? More than 800 illegals who were targeted in the raid managed to escape. And of course, as can be expected based on what we saw with Kate Steinle, there were repercussions.

In March of 2018, The Washington Times reported that ICE Director Thomas Homan had announced that three of those 800 illegals who eluded border enforcement agents in February, thanks to Schaaf’s tip-off, had been arrested for robbing, driving drunk, and wife-beating (spousal abuse)—within 30 days of their prior escape from deportation.

Press Secretary Sarah Huckabee Sanders said at the White House: “I think it’s outrageous that a mayor would circumvent federal authorities and certainly put them in danger by making a move such as that.”

Sanders’ boss President Donald Trump also agreed. He has asked his administration to look into a punishment fitting Schaaf’s crime—which was basically that of a “gang lookout.” Another word that springs to mind is “snitch.” President Trump is also pushing hard to have sanctuary cities lose federal grant money.

So what is Schaaf up to now? Believe it or not, she is running for re-election, and according to the latest polls as reported by The Mercury News, she has a commanding lead. But this absolutely defies comprehension and just proves the lunacy of some on the left.

Consider that on top of violating federal law, Schaff’s administration has been beleaguered by scandal after scandal. Her police department has been tainted so badly by an underage sex scandal that three different police chiefs were hired and quit within just nine days of each other back in June of 2016.

So what was Schaaf’s solution? Heaven forbid she take personal responsibility for her inability to work with her own police department. No sir. Instead, she brought in armchair quarterbacks. As reported by the Los Angeles Times: “The Oakland Police Department will now operate under civilian control after the agency parted ways with its third police chief in nine days.” Per LA Times reporter James Queally, that announcement came from Mayor Schaaf. Notice how she conveyed the “agency parted ways” versus a police chief opting out of his own volition.

So here you have a politician who can’t run her police department, violates federal law, and consistently fails to uphold the oath of her office, and yet she is up for re-election and leading in the polls.

You see, despite all commentary to the contrary, sanctuary cities are illegal, violate federal law, and based on all studies, increase crime rates. So, notwithstanding Schaaf’s counter-argument, having a sanctuary city does not shield you from the law. So it is only quite appropriate that a bill designed to send law-breaking politicians to jail should be named after her.

Let’s be clear—a sanctuary city, as defined by America’s Voice, is “a city (or a county, or a state) that limits its cooperation with federal immigration enforcement agents in order to protect low-priority immigrants from deportation, while still turning over those who have committed serious crimes.”

Therein lies the problem. The definition is vague and full of subjective statements that leave room for others to judge. For example, “serious crime.” Well, what exactly constitutes a serious crime in your opinion? Do you see the problem here? It’s all subjective. So who has to make the call? Our US Department of Justice. And we have seen how effective the DOJ and Jeff Sessions have been of late. Thus the prosecution of Schaff for violating federal law is probably never going to happen, despite the fact that the Justice Department “says” it is looking into filing charges.

Someone should remind Schaff that the laws of the United States give the president control of immigration policy, and the Constitution gives the president, not self-righteous mayors, control of foreign policy, immigration, and border security.

Title 8 U.S.C. 1324 makes it quite explicit that harboring and concealing from detection illegal aliens is a felony, whether committed by individuals or sanctuary city officials:

Harboring—Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who—knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.

Sanctuary city mayors are in clear violation of federal statute…period.

Thus the reason for having to create the Schaaf law. It is a way to bring sanity back into this crazy mess we call immigration and a way to hold our elected officials accountable, because it would appear that many of our elected officials simply don’t care about our immigration laws almost as much as illegals don’t. Maybe more, considering they swore an oath to uphold the law.

So explain to us again, Mayor Schaaf, how “exactly” are you protecting the residents of Oakland. You are in fact harboring criminal fugitives like Armando Nuñez-Salgado. According to ICE, Armando Nunez-Salgado is a 38-year-old citizen of Mexico and documented gang member who is currently wanted for removal as a previously removed criminal alien. Nunez was convicted of the following felony charges: force and assault with a deadly weapon, burglary, and hit and run. An immigration judge ordered him removed from the US on May 2, 2000, and he has been removed from the US to Mexico on multiple occasions since then. His most recent removal was Jan. 19, 2010. Nunez unlawfully re-entered the US at an unknown date, and despite numerous attempts by ICE to locate his whereabouts, he currently remains at-large.

The fact is that a majority of America wants mayors like Schaaf to be held accountable and tried in a court of law. Thankfully, Congressman King is working hard to get a bill that will do just that. According to a press announcement by King, “I want lawless sanctuary city politicians to hear this message clearly: if you obstruct ICE, you are going to end up in the cooler.”
